

General Terms of Business
(For groups and conferenceguests we refer to the "general business conditions for hotel accommodation for groups and conferenceguests")
Damp Touristik GmbH, 24351 Damp, Germany, referred to hereinafter as "Damp", rents out holiday homes, holiday apartments and hotel rooms.
1. A rental agreement is only concluded when Damp has confirmed it in writing. The full invoice amount is due for payment at conclusion of agreement for any stays without prior registration, for short-break reservations and for in situ rental extensions. If the invoice amount is not paid, Damp has the right to withdraw immediately from the agreement.
2. Damp makes every endeavour to satisfy guests’ wishes in respect of the location of holiday apartments and holiday homes. However, Damp asks guests to understand that no guarantee can be given for a specific location that may be desired, or that other special wishes can be met.
3. On the day of arrival, the rented accommodation unit will be available from 5 p.m. (from 2 p.m. in the case of hotel rooms). Please vacate your accommodation unit or hotel room by 10 a.m. on the day of departure.
4. Damp rents out furnished accommodation units. Tenants are requested to treat the rooms and inventory with care. Any damage caused to the rented property through the fault of the tenant during the tenancy must be reimbursed by the tenant.
5. The rental price and any ancillary costs are detailed in the currently applicable price list. Prices for special offers are detailed in the respective offer description. All other services, e.g. in restaurants and sports facilities, are payable by the guest at the place where such services are rendered, unless the catalogue explicitly states that they are included in the price.
6. In the case of telephone bookings, these terms and conditions are incorporated in the rental agreement and any lack of authorisation on the part of the caller is deemed to be approved unless a written cancellation is made within one week after the confirmation of reservation is received. Damp shall draw attention in writing to the fact that no response means tacit approval.
7. The tenant does not have the right to accommodate more persons in the rented accommodation than stated in the currently applicable price list. If this rule is breached, Damp has the right to cancel the rental agreement and to impose an over-occupation surcharge for the duration that the accommodation is used in breach of agreement.
8. The total rent as confirmed by Damp must be credited to one of the bank accounts of Damp no later than 28 days before the tenancy begins. If this payment is not made, Damp reserves the right to cancel the booking. The guest folder and key will be handed over at the reception desk on arrival. Guests must present proof of payment at the reception desk.
9. A deposit may be required for any spare keys that are provided: €13 per key. If a key is lost, Damp is compelled to charge an amount for the necessary replacement key and/or to replace the lock: €13 per key.
10. Reservations made by the guest are binding for both parties to the rental agreement. Both parties have the right to cancel the agreement at no cost up to a minimum of 28 days before arrival. If the guest cancels the agreement, the guest will be charged the following cancellation fees:
- For a total reservation value of less than €200 and a maximum stay of one night, no cancellation fee will be charged for cancellations no later than 24 hours before arrival (the guaranteed check-in time for the rented object shall apply). Calculation of the total reservation value does not take into account any subdivision according to time periods or rented objects.
- no cancellation fee if written cancellation is received no less than 28 days before the rental period begins;
- if written cancellation is received within 28 and 8 days before the rental period begins, a cancellation fee equal to 25% of the ordered services will be charged;
- if written cancellation is received within 7 days before the rental period begins, a cancellation fee equal to 50% of the ordered services will be charged;
- if no written cancellation is received by Damp before the rental period begins, the cancellation fee is 80% of the value of services ordered;
- if cancellation of services is received after availing of the services (e.g. in the case of premature departure), a cancellation fee equal to 80% of the ordered service shall be charged.
If the ordered service could be rented to other persons, the cancellation fee will be reduced to 10% of the value of the ordered service. The tenant has the right to prove that Damp incurred lower costs in the individual case. Cancellations must be made in writing in all instances and require confirmation by the other party.
11. The hotel has the right to withdraw from the agreement for good material cause, for example if
- force majeure or other circumstances over which the hotel has no control render it impossible for the agreement to be fulfilled;
- rooms are booked with misleading or false information, e.g. concerning the customer or the purpose of booking;
- the hotel has justified cause to believe that use of the hotel’s services might jeopardize the smooth operation, safety, security or public reputation of the hotel, without such adverse impacts being attributable to the hotel’s own sphere of control or organisation;
12. The House Rules on display form an integral part of the rental agreement. In the interests of all holiday guests, dogs are not allowed on the main beach between Vital Centrum Damp and Aqua Tropicana. Dogs are permitted on the south beach.
13. Any liability on the part of Damp for breach of obligations or a tort is limited to wilful and grossly negligent actions. This limitation of liability does not apply in cases of personal injury to life, body or health, to claims deriving from material breach of contract or to compensation for consequential damages. In such cases, Damp bears liability regardless of fault.
14. Cancellation insurance is not included in the rental/travel price; we therefore urge you to take out such insurance – for example with Die Europäische travel insurance company (infoline under +49 89-4166-1767).
15. Verbal agreements that deviate from the terms and conditions of the rental agreement require written confirmation by Damp to obtain effect.
16. Should any of these provisions be or become invalid, this shall have no effect on the validity of the remaining provisions. The invalid provision shall be deemed to be replaced by a provision that corresponds in legally permissible manner to the business and financial content of the invalid provision.
17. The place of jurisdiction is Eckernförde; German law shall apply to legal relations between the parties.

Arrival recommendations
Drive to the barrier at the Ostseehotel, take a ticket and park in front of the Ostseehotel. Check in at reception. Take your car within 1 hour (free of charge) using the same ticket past the barrier again and back to the large car park. The free bus will take you to the Ostseehotel.

Arriving from the North:
Take the A7 towards Schleswig through Flensburg, then take the B203 towards Eckernförde, exit at Ostseebad Damp
From Puttgarden: Take the B207 towards Oldenburg, and then the B202 towards Kiel, from Kiel take the B76 towards Eckernförde, and then take the B203 to Damp.
Arriving from Hamburg:
Take the A7 from Hamburg and take the Rendsburg/Büdelsdorf – Damp exit. Take the B203 main road towards Eckernförde, then take the B203 towards Kappeln and exit at Damp.
